Terms and Conditions of Use (01/01/2018)
THE ACCEPTANCE OF THIS INSTRUMENT IS INDISPENSABLE IN THE USAGE OF THE WEBSITE AND GAME WYD. Carefully read the Terms of Use before using the website and game. Use of the site and game offered by RAID HUT in disagreement with the following terms will imply in the respective civil and/or criminal penalty.
RAID HUT LICENCIAMENTO DE JOGOS DIGITAIS LTDA. a legal entity governed by private law, registered with the CNPJ / MF under number 23.877.777 / 0001-34, located at Rua do Apolo, 181, ME-PP12 and ME-SP07, Recife, Pernambuco, CEP: 50030-220, hereinafter referred to as RAID HUT, establishes the present instrument, called TERMS OF USE, to whose conditions and clauses the User adheres and agrees to submit, as well as any future changes.
1. REGISTRATION
1.1 The registration in the game "WYD" ("Game") must be performed by a person authorized to practice all acts of civil life (age of 18 years or older) and the registration of underage persons is prohibited, under penalty of civil and/or criminal liability.
1.2. By using the Game, the User declares that he/she is over 18 years of age and fully capable of performing all acts of civil life.
1.3. Only one registration per person, physical or legal, is allowed, and registration for legal entities must be performed by its legal representative.
1.4. If the User does not have the civil capacity and accepts the Terms and Conditions of Use, then it will also be understood that the statements have been provided by his/her legal guardian. In the case of legal entities and other subjects of law, it will be understood that, by adhering, it has been duly represented in accordance with its existing internal acts.
1.5. By registering, the User also agrees to Raid Hut's privacy policy .
2. ACCOUNT AND PASSWORD
2.1. It is the User's duty to (a) register with accurate, precise and true information; (b) keep the confidentiality of their account identification and password; (c) update and revise their account frequently; and (d) promptly notify Raid Hut in the event of any unauthorized use of their account or any breach of security.
2.2. The User is solely responsible for all activities that are performed through their Game account, and Raid Hut shall not be liable for any loss or damage resulting from their failure to comply with the obligations hereunder.
2.3. Raid Hut reserves the right to use all valid and possible means to identify its users, as well as to request additional data and documents that it considers pertinent in order to check the Personal Data informed.
2.4. If Raid Hut decides to check the veracity of a user's registration data and if it is found that there are incorrect or untrue data, or if the user steals or refuses to send the required documents, Raid Hut may block the registration, or cancel it permanently, without prejudice to other measures that it deems necessary and opportune, not attending to the user, for that reason, any right of indemnification or compensation.
2.5. Under no circumstances will the sale, sale, rent or other transfer of account be allowed. Nor will the maintenance of more than one registration by the same person or the creation of new registrations by persons whose original registrations have been canceled due to violations of the Raid Hut policies.
2.6. The Raid Hut User may purchase, through their Game account, the copper, silver and gold coins, these being the virtual coins available in the Game, which shall be used exclusively on the Raid Hut platform, being expressly prohibited external commercialization.
2.7. Raid Hut provides users with items from the Game's online store ("Store Items") that can be obtained through a specific credit, called Nordic Point ("NP"). NPs can be purchased through the Game's website and are linked to the User Account and are therefore non-transferable. The User may purchase Store Items by spending a corresponding amount of NP on the Game's online store.
3. ACQUISITION OF NPs
3.1. A usermay purchase NPs from the Raid Hut Site. Payment of credits purchased online can take place in the following ways:
(i) by authorized and valid credit card.
(ii) through boleto bancário (bank slip).
3.2. By choosing to pay through one of the modalities described above, the User is expressing his decision to acquire NPs in the manner defined by this agreement of wills.
3.3. Raid Hut may also make available NPs to other accredited and related Internet sites on the Raid Hut Website. Accredited resellers are only those listed on the Raid Hut Website.
3.4. The user acknowledges that they are not permitted to:
(i) exchange and/or sell NPs between users involving money or real-world values;
(ii) purchase virtual items and/or components of the Game Software outside the conditions established in this agreement (ie purchase of NPs and/or virtual items with third parties outside the accredited network).
3.5. Failure to comply with this clause will be considered a violation of the terms of this agreement and will result in permanent blocking of the game accounts of the users involved in the transaction. Any questions about the accredited network or about the regularity of the transaction should be directed to the Raid Hut Support Center.
3.6. Raid Hut will not be able to make available to the User nor be responsible for NPs acquired outside of the accredited resellers.
3.7. Raid Hut reserves the right to modify payment methods and authorized credit cards at any time.
3.8. Any and all problems with the means of payment chosen by the User shall be promptly communicated to Raid Hut by the User through the Support Center.
3.9. In case the user is under 18 years of age, the acquisition of credits in Brazilian Real currency must be carried out together and in the presence of parents and/or guardians.
4. INFORMATION PRIVACY
4.1. All information or personal data provided by the User to Raid Hut is stored on servers or high-security magnetic media. Raid Hut will take all reasonable steps to maintain the confidentiality and security described in this clause, but will not be liable for damage that may result from the violation of these measures by third parties using public networks or the Internet, subverting security systems to access User information.
5. COPYRIGHT
5.1. The content of information contained on the Raid Hut website, as well as its trademark, business name, domain name, programs, databases, networks, and files, are the property of Raid Hut and are protected by international copyright laws and treaties, trademarks, patents, models and industrial designs. The copying, distribution, use or publication, in whole or in part, of any material or part of the site and all the content offered in it without prior and express authorization from the copyright holder is strictly forbidden.
6. EDITING, MODIFICATION, AND EXCLUSION
6.1. Raid Hut reserves the right, at its sole discretion, to edit, modify or delete any document, information or other content available in the Game.
7. INDEMNIFICATION
7.1. The User undertakes to reimburse Raid Hut for all expenses that Raid Hut, its subsidiaries, companies that are controlled by or that have control over Raid Hut, directors, administrators, employees, and agents shall bear as a result of a possible legal action in which the violation is discussed, whether by action or omission, use of the site or violation of this instrument by the User, including but not limited to the value of any conviction, costs and expenses and legal fees.
8. REDIRECTION
8.1. Raid Hut may link to other sites on the network with the Game, which does not mean that these sites are owned or operated by Raid Hut.
8.2. Raid Hut is not responsible for materials, information or content posted on third-party sites, nor for the availability of these sites, it is up to the User to use their own judgment, precaution, and common sense when accessing third-party sites, and to check privacy policies and terms of use.
9. RESPONSIBILITIES
9.1. The User acknowledges and agrees that:
(i) assumes all risks related to or resulting from the use, viewing or access to the Game, to the maximum extent permitted by applicable law;
(ii) in spite of Raid Hut's maximum effort to ensure continuity and maximum security of the Game, the system may not be available due to technical reasons, Internet failures or any other fortuitous event or force majeure outside Raid Hut’s control;
(iii) Raid Hut is not responsible for the suitability, veracity or quality of the information and posts provided by the Users, as well as for the ability to contract Users or for the veracity of the personal data inserted by them in their registers;
(iv) Raid Hut shall not be responsible for the effective fulfillment of the obligations assumed by the User;
(v) Raid Hut, being a company responsible for the publication of the Game, is not responsible for Internet access, and the User is responsible for the costs associated with connecting to the Internet.
9.2. In the event that one or more Users or any third party initiates any type of claim or legal action against another or other Users, all Users involved in the claims or actions exempt from all liability to Raid Hut and its directors, managers, employees, agents, workers, representatives and prosecutors.
10. LIMITATION OF LIABILITY
10.1. Raid Hut shall not be liable in any instance for any use, content or any other fact related to the Game by: (i) any direct losses; (ii) any indirect, special or consequential losses; and (iii) any loss of business, loss of revenue, profits, anticipated profits or savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of data or information.
10.2. The limitations of liability set forth herein shall also apply if Raid Hut has been expressly advised of the potential loss.
10.3. In addition, Raid Hut is not responsible for any action or omission of the User based on the information, advertisements, photos or other materials posted on this website.
11. GENERAL PROHIBITIONS
11.1. Without prejudice to the other fences provided in this instrument, the User undertakes not to :
(i) violate this term and the other rules provided for in applicable legislation.
(ii) violate or attempt to breach any security measures of Raid Hut;
(iii) disrespect the rules of the Game ;
(iv) access, attempt to access or disclose any account or third party identification contained in Raid Hut;
(v) copy, modify, reproduce, delete, distribute, download, store, transmit, sell, resell, publish, reverse engineer or create derivative works of any products made available by other Users;
(vi) publish or submit any inaccurate, false or incomplete information;
(vii) pretend to be to another person or organization;
(viii) assault, slander, libel or defame other Users;
(ix) advertise or sell in-game items, gold or currency accounts to other users;
(x) use third party software to interfere or gain an improper advantage in the game;
(xi) use of SPAM or any other inappropriate, libelous or illegal disclosure practices on Raid Hut;
(xii) use illegal means of publicity, or cause any harm to Raid Hut users, third parties, or Raid Hut itself.
(xiii) use software or techniques to circumvent the personal computer account limit set by Raid Hut;
(xiv) use software to automate game functions;
11.2. Any conduct contrary to the above may be punished with the suspension or cancellation of the registration as Game User, without prejudice to legal actions that may occur for the configuration of crimes or contraventions or civil damages that may cause the other Users.
12. MODIFICATIONS TO THE TERMS OF USE
12.1. It is permissible for Raid Hut to change, at any time and without prior notice to Users, the clauses and conditions set forth in this instrument, aiming at the improvement of the Game. The new Term with its respective amendments will enter into force ten (10) days after published on the website, and the User shall, within a period of 05 (five) days counted from the publication informing of the modifications, notify Raid Hut via e-mail, if they do not agree with the changes made, in which case the contractual link will no longer exist.
12.2. If there is no manifestation within the stipulated period, it will be understood that the User tacitly accepted the new Terms of Use, submitting to them.
13. SYSTEM FAULTS
13.1. The User acknowledges and agrees that Raid Hut shall not be liable (i) for any damage, loss or loss in User equipment caused by system, server or internet failures arising from third party conduct; (ii) damages arising from virus attacks on User equipment as a result of access to and use in the Game or as a consequence of the transfer of data, files, images, texts or audio contained therein.
13.2. Users will exempt Raid Hut from liability for damages incurred as a result of damages resulting from technical difficulties or failures in systems or the internet.
14. SANCTIONS
14.1. Without prejudice to other measures, Raid Hut may warn, suspend or cancel, temporarily or definitively the user registration or impose a sanction that negatively impacts on its reputation, at any time, initiating legal actions and / or suspending access to the Game if a) the User does not comply with any provisions of these Terms and other policies of Raid Hut; b) failure to fulfill with User duties; c) practice fraudulent or criminal acts; d) can not verify the identity of the User or any information provided by them is incorrect; e) Raid Hut understands that the ads or any actions of the User have caused any harm to third parties or the Raid Hut itself or have the potential to do so.
15. TERMINATION
15.1. Raid Hut may terminate, at its sole discretion, the Game and remove any content posted on it. Raid Hut may also restrict User access to any or all of the Game at any time, with or without cause or prior notice, and for any reason or motive.
15.2. If a User wishes to terminate their account, they may cease accessing and using the Game. Raid Hut shall not be liable in any event for maintaining or returning the published content, account, identification or password of the User.
16. SCOPE
16.1. These Terms do not generate any partnership, mandate, franchise or employment relationship between Raid Hut and the User. The User acknowledges that Raid Hut is not a part of any transaction, nor does it have any control over the quality, safety or legality of the products advertised and the truth or accuracy of the advertisements. Raid Hut can not ensure the success of any transaction, nor can verify the identity or personal data of users. Raid Hut does not guarantee the accuracy of any third party posting that appears on the Game.
17. REASONABILITY
17.1. By using the Game made available by Raid Hut the User agrees that the limitations of liability cited in this instrument are reasonable. If the User does not agree on the reasonableness, they should not use the Game.
18. UNREACHABLE PROVISIONS
18.1. If any provision of this instrument is or is subsequently found to be unenforceable, void or void by applicable law, this will not affect the enforceability and validity of the other provisions herein.
19. FORUM
19.1. The forum of the district of Recife/PE/Brazil is elected as the only one competent to resolve eventual controversies regarding the interpretation and fulfillment of this Agreement, independently of another, however privileged it may be.
